    I don't know which forum is best for this.

    What are other's experiences w/ insurance settlements? I'm C4/5 complete, 5 yrs post, 50yrs w/ no current significant health issues. I'm covered under a Pennsylvania workers comp insurer. The reinsurer is General Reinsuranse Corp. It seems like most of the people here are still involved w/ insurers. Any idea what % of sci cases are settled and over what time periods? I sure would like to end this abusive relationship w/ my insurer.

    workers comp is different state by state, a workers comp lawyer for your state is the only way to get this kind of advice.

      I've got a lawyer. He's ok, but my type of case is rare in PA comp. The system is designed to deal with bad backs and other relatively low $ cases.
      According to him, my case is the biggest thing in years. So, basicly, my lawyer doesn't know. I just was curious about other people's experiences. There's probably no rule of thumb with settlements.

        i would post some questions in that forum i highlighted.
        comp is different in each state. in ny state the max you will ever get is 400 a week wc payment even if you made over 100,000 a year. so a settlement are quite low for a sci . plus you lose your future medical coverage. i think WC may be way better than Medicare for getting things paid for.
        in my case it wouldnt be worth it to take a settlement if it was offered.
        they usually only offer settlement for 8 years payments in this state.
        is your lawyer a WC specialist, he should know all these answers if he is.

            Lifecare plan

            Not being from Pa., I can't be sure of this information. However, I did stay at a Holiday Inn Express last night. First of all, settlement in w/c cases is rare, since complications from your SCI may develop over time and a judge might rule that the carrier is still responsible despite the settlement. That being said, I would explore the possibility with the best w/c lawyer you can find. A lifecare plan needs to be developed in order to determine the potential cost of your condition for which the carrier will be responsible. Let's say that will be 20m over the course of your life and your life expectancy is 40 more years. The carrier will need to set aside the amount of money, with interest, they will need to provide for your care. I don't know the math, but let's estimate it will take 5m invested now to become 20m over 40 years. The 5m is the amount that will be in play. The settlement would be some percentage of that amount, minus your attorney's cut, which should be negotiated. Suppose you end up with 2.5m. You can purchase Medigap Insurance, longterm care insurance, life insurance, BC/BS to insure that equipment is covered. A sound decision can only be made once you know the nut the carrier must maintain and you make an honest assessment regarding your health given the longterm implications of SCI. I hope this helps.

              each state is too different to speculate, in NY WC state settlements are very common. however its usually based on about 5 to 8 years of wc payment plus a set aside for future medical (you never get that money or the interest, even if you never need it it) so at the max rate of 400 a week your settlement max is about 168,000 minus attorney fee's. When the set aside medical runs out you go on the Medicare medical plan.
              in NY state once settled , it is never reopened, its done forever.
              the injured party does not have to take a settlement. , nor does the insurance company have to order one. For less catastrophic injuries it may make sense to the injured party since once they settle, the injured person can do any type of work they desire without worrying about WC hassles.
              its not like regular insurance company setlements, at least in ny state..

                  This economic analysis has been customized to accommodate changing health and care needs as this young prototypical quadriplegic ages, and considers differing needs during advancing stages in life: ages 20 to 35, 35 to 55 and 55 and beyond. Understandably, the aging process is extraordinarily vicious on survivors of spinal cord injuries and takes its greatest toll during the last chapters of life.

                  The probable future costs for spinal cord injury related surgical interventions and hospitalizations, have not been cost-factored in this analysis and lost income from earnings and investments are not included.

                  This is an example of a customized lifecare plan to address special needs, which will differ from person to person.

                  I. HEALTH AND HUMAN SERVICES COSTS FROM AGE 20 TO 35
