Woman Who Got DUI in Wheelchair Challenging Law

Woman Who Got DUI in Wheelchair Challenging Law
A Florida woman who was in a motorized wheelchair when she collided with a vehicle in the street and was charged with driving under the influence with a blood alcohol content of .12, is claiming in court that her wheelchair is not a vehicle.

Cynthia Christensen's attorney says a wheelchair is used to help people "walk" not ride, and wheelchairs are not specifically mentioned in the state's drunk driving law.

The state says a wheelchair does meet the definition of a vehicle. The law defines a vehicle as "every device, in, upon, or by which any person or property is or may be transported or drawn upon a highway, excepting devices used exclusively upon stationary rails or tracks."

I wonder if this would apply to a manual wheelchair as well?

The law in Norway defines a person in wheelchair, both manuel and powerchairs, as a walking person by law. It was a lawsuit two years ago about it. So here we can drink and keep on rollin'

kind of funny, can only imagine how great it would be to get pulled over by a cop in my "vehicle"/ manual wc.
