In the event the CDRPA does not pass as part of S.22, Rep. Tammy Baldwin reintroduced it under H.R. 307 on 1/08/09. Steps are already in place to keep this bill alive if it doesn't pass today.

Here is a summary of S 22 for background:


S. 22: The Omnibus Public Land Management Act of 2009

This omnibus legislation combines more than 160 individual measures reported by the Senate Energy and Natural Resources Committee during the 110th Congress, including 73 bills already passed by the House. The Senate has elected to combine these measures for procedural reasons and passed the bill 73-21 on January 15, 2009.

The bill includes measures affecting the National Park Service, Bureau of Land Management, Bureau of Reclamation and U.S. Geological Survey within the Department of the Interior as well as the Forest Service within the Agriculture Department, National Oceanic and Atmospheric Administration within the Commerce Department and the Smithsonian Institution. The package combines wilderness designations, land conveyances and exchanges, river and trail designations, historic preservation measures, and important water settlements.

Among the bill’s most prominent individual pieces are wilderness proposals in West Virginia, California, New Mexico, Colorado and Oregon, authorization for the National Landscape Conservation System within the BLM, important forest landscape restoration legislation, the San Joaquin River Restoration Settlement, and the Christopher and Dana Reeve Paralysis Act.

Enactment of S. 22 will strengthen our National Park System as it nears its centennial anniversary, improve forest health, facilitate better management of our public lands through authorization of the National Landscape Conservation System and increase the quantity and quality of water provided to numerous local communities. In addition, invaluable historic and cultural resources, including the sacred ground of American battlefields, will receive better protection under this legislation.

The bill will include an amendment regarding management of hunting, fishing and trapping which has the full support of the National Rifle Association.

Each of these bills is an important accomplishment for its sponsor and the constituents who support it; taken as a whole, this package is truly landmark legislation which will improve the quality of life for millions of people in communities across the country.

Vote on S 22 -- close but not quite

The final vote on S 22, the public lands bill that included CDRPA, fell two votes short of the 2/3 vote necessary to pass. It was much closer than anyone expected, which in a way makes it even more painful. But it is still a positive sign. I think the calls from ccers helped; at least one of the members who got a call today from a cc'er (Leo), Stephanie Herseth Sandlin, had concerns about other parts of the bill and hadn't decided how to vote as of this morning but ultimately voted for it and two of the three members IMHopeful mentioned above voted yes (Charlie Dent and Frank Wolf). The vote was 282-144, so if two votes had changed it would have passed 284-142. You can see how members voted here:

I am not sure what happens next, other people in my office are working on it. What I can tell you is that this bill and the items contained in it are getting a lot of attention and it isn't a matter of if we will get them done but when and how, with the answer on when being sooner rather than later.

Since the vote was so close there have already been several conversations about what changes could be made that would allow the bill to pass the House without causing too many problems in the Senate. From what I know, it sounds very encouraging. It will take a while longer, because if the House makes any changes the Senate will have to consider the bill again which could take some time, but the House won't make any changes without checking with the Senate to make sure the Senate can pass it again.

I'm not close enough to it to have a good list of potential swing votes, but my undersanding is that we got all of the potential Democratic votes on S 22 so the goal is to get a couple more Repubilcan votes. I think the best target group for CCers to contact would be Republicans who have cosponsored CDRPA this year or in the past but voted against S 22 yesterday to remind them that CDRPA is included in S 22 and the SCI community is paying attention to the votes on S 22.
